    That guy died a long time ago? I remember posting it but not sure how far back but it is months ago. Unless there was more than one running that gig.

    Unless that is, perhaps I posted when he was put on a ventilator and he just hung on this long? Hard to recall.

      He died Sept 13 . . . so yesterday. He was 62 and was living in Denver . . .

      He did what Luv2kruz said . . . nice guy . . .

                Which is why that column/opinion was posted.

                We are of course working only on 'conjecture' based on past practice and jurisprudence. Which is not directly applicable. The same way that court and arbitration decisions regarding mandatory influenza vaccinations have been referenced, but are not directly applicable as the factors are considered somewhat different.

                We do know that any worker who contracts COVID while in the course of employment, is eligible for WSIB and therefore ineligible to sue their employer. If their employer is registered with the WSIB.

                In November 2020 the government of Ontario passed Bill 218 Section 2 of this Act provides that no cause of action arises against any person as a direct or indirect result of an individual being or potentially being infected with or exposed to coronavirus (COVID-19) on or after March 17, 2020 as a direct or indirect result of an act or omission of the person if,
                (a) at the relevant time, the person acted or made a good faith effort to act in accordance with,
                (i) public health guidance relating to coronavirus (COVID-19) that applied to the person, and
                (ii) any federal, provincial or municipal law relating to coronavirus (COVID-19) that applied to the person; and
                (b) the act or omission of the person does not constitute gross negligence.

                So that protects employers regarding their employees, and most likely their customers if they become infected due to exposure at the workplace/facility.

                Whether or not an employer can be sued by an employee who suffers and adverse reaction?
                Until we have either a directly applicable court case, arbitration decision or the government passes legislation directly related to this, any definitive would be conjecture.

                However based on previous outcomes, the employee might be eligible for WSIB coverage, meaning that they could not sue. The employer if sued might use a defense that they were following public health recommendations/guidelines. Those employers who were in sectors where vaccination has been mandated, such as transportation by the federal government would most likely have a valid defence in that the decision was taken out of their hands and required by the government.

                    Canada's largest school board has unveiled a new policy requiring all public-school staff to be vaccinated against COVID-19 by November 1 or risk losing their jobs. The Toronto District School Board (TDSB) announced the move on Tuesday, with the mandate set to impact school board employees, trustees, and transportation drivers.

                    Those who refuse to be vaccinated by November 1 may be subject to "disciplinary action, up to and including termination for employees," according to the policy. Exemptions can be requested based on medical or religious grounds. However, those who are exempt from having the vaccine will have to undergo regular testing. All duty to accommodate requests must be balanced against “the Board's obligations to protect the health and safety of employees and students”.

                    As of Tuesday, approximately 94% of the 40,000 TDSB staff members have already been vaccinated, according to the board. Children under 12 are not yet required to be vaccinated.

                    Prior to the TDSB, the Ottawa-Carleton District School Board also required its employees to be fully vaccinated by September 30.

                    "Employees who are not vaccinated and who do not initiate the vaccine process by September 30th will be subject to additional employment conditions/restrictions which may include being placed on a Leave Without Pay," the board mandated.

                      Although many are doing this but would like to see this as a Provincial mandate so all must abide.

                                Are there other stats that can help put that into context?

                                Imagine:

                                - 50,000 fans attended a Blue Jays game and 50 of them die
                                - 1 plane crash every 500 flghts, would you still fly?
