It is clear to me that the DOJ will have little trouble in proving the two essential elements of criminal activity that Trump demonstrated on and before Jan. 6th, 2021.
1. Mens rea: the mental capacity to form the intent and plan the criminal activity.
2. Actus reus: The physical act of committing the crime personally or by aiding and abetting said criminal activity.
More actors will now be forced to step forward to avoid charges of direct complicity in supporting the insurrection, a Federal crime on its own.
